Following our previous article about the employee’s compensation insurance in Hong Kong, we are now explaining what are the steps to follow in case one of your employee suffers from a work accident or an occupational disease in Hong Kong.
#1 – Notification of the employer
If an employee sustains a work injury or suffers from an occupational disease, he/she should inform his employer as soon as possible and provide with full details of the work injury or medical occupational disease.
#2 – Report to the labor department
Once the employer has the knowledge of the work accident/occupational disease, he/she must report it to the labor department within 14 days (in case of injury) or 7 days (in case of death). Not reported the accident in due time may lead to prosecution and a maximum fine of HKD 50,000.
#3 – Fill in the appropriate form
The employer must fill in one of the below form and send them in original to the labor department with the copies of the medical receipts (the original of the docs must be kept for your insurer)
- work injury leading to an incapacity of working for less than 3 days => form 2b
- work injury leading to an incapacity of working exceeding 3 days or to death => form 2
- occupational disease leading to incapacity or death = form 2a

#4 – Report to the insurance company
The original of the medical sick leave certificate and other medical receipts must be sent to your insurer together with a copy of the labour form (2, 2a or 2b)
#5 – Settlement
During the medical leave, the employer pays periodical payments to the injured employee at 4/5 of the difference between the employee’s monthly earnings at the time of the accident and his/her monthly earnings during the period of temporary incapacity.
The medical expenses must be paid to the injured employee with daily maximum of medical expenses payable as below:
- In-patient treatment or out-patient treatment: HK$300
- Both in-patient and outpatient treatment on the same day: HK$370
The modality of the settlement vary depending on the length of the medical leave.
